Barnstable Town Council Seeks to Ban Small Cannabis Business

At the last Barnstable Town Council Meeting 7/19 there were some major developments you should be aware of, if you care about the cannabis industry on Cape Cod.

Due to tricky maneuvering by Council President Eric R. Steinhilber (staunch Prohibitionist, and sponsor of the BAN), 2 things happened:

  • Cannabis zoning was withdrawn! (Mr. Steinhilber subtly indicated to the Zoning article sponsors that he would also withdraw the BAN article... **spoiler alert** he did not)

This means only the BAN article will be discussed moving forward, which is EXACTLY what the Prohibitionists want!

WE NEED to ensure this article gets amended properly. Currently, the Prohibitionists are offering exceptions for Research, Testing, and Cultivation. While this is good progress, opening their eyes to business categories beyond retail, THIS IS NOT GOOD ENOUGH!! 

We MUST ensure more exceptions are made to allow for SMALL BUSINESS.

YOU NEED TO CALL & EMAIL THESE COUNCILORS and tell them they MUST support small business by pushing for amendments to allow for Product Manufacturing and all categories of Microbusinesses. 

The precedent is there for them to use: Shutesbury tempers pot moratorium at Town Meeting

"Lewis’ amendment made an exception in the proposed moratorium for “tier 1 or 2 cultivation, craft co-ops, microbusinesses and home-based production of marijuana products,” all terms defined in G.L. c. 94G, which governs marijuana in Massachusetts"

Although it is our group’s position that properly regulated adult-use retail businesses should be immediately zoned for success, we also understand that the potential solution (short-term) could be a compromise which exempts specific non-consumer touching license types from any ban/moratorium.  Consider this a phased approach which would allow non-consumer touching businesses a chance to establish themselves, while enacting a temporary moratorium on retail stores until sometime next year.

License types such as:

•Microbusinesses 

•Product Manufacturing 

•Craft Cultivation Co-ops

•Small Scale Cultivation

•Third Party Testing Facilities 

•Research 

•Third Party Transport 

Small businesses can and should have a chance at the historic ground-level start in this exciting space (1.8B industry by 2021 in MA) and as the commercial hub for the Cape, Barnstable should take a leadership position in allowing this opportunity within its borders. Allow non-consumer touching license types to establish themselves. 

And at the same time, create a “Cannabis Advisory Committee” and study the local effect of the license types permitted, while also studying the retail impacts in neighboring communities during the extended moratorium period. With an additional objective to properly address the lack of medical cannabis access in Barnstable.

If you do not take action, a BAN will happen in Barnstable!!
